The front seat in most passenger vehicles will collapse backward during relatively modest rear impacts. This can result in the seat occupant being thrust into the back seat or ejected. Head and spinal injuries can occur when the occupant strikes his or her head on portions of the vehicle behind the seat. Seat back failure can also lead to a complete loss of control, making a moderate accident more severe or causing additional collisions.
The Gilbert Law Group has been involved in litigating car accidents involving seat back collapse for several years. We've represented clients in Colorado and across the nation.

Seat back failures are attributed to failures in design and poor installation of seats in cars and trucks. Automakers often use materials that do not properly support the weight of passengers or use weak materials that cause deformity in the seat frames.
Automakers defend seat back collapse cases, in part, by claiming a collapsing or “yielding” seat back assists occupants in “riding” down a collision. This claim lacks medical and engineering support and is further undermined by the introduction of stronger seat back designs in newer vehicles, including the “Catcher’s Mitt” seat design recently introduced by General Motors.
